Terms of Service

These terms explain how TM8 project requests, scope review, payment, production, reviews, delivery rights and CAD file handling work.

Overview

These Terms of Service apply to project requests, estimates, payments, production work and digital deliverables provided by TM8 Piotr Wołoszyński, trading as TM8. By submitting a project request, approving a scope, making a payment, or commissioning TM8 to provide industrial 3D visualization services, the client agrees to these terms unless a separate written agreement is signed.

Services

TM8 provides industrial 3D visualization services based primarily on existing engineering data, including CAD-based animation, technical product visuals, cutaway views, exploded assembly visuals, product highlights and still images.

TM8 does not provide engineering validation, product certification, legal surveying, manufacturing approval, safety certification, CFD simulation, FEA simulation, or construction documentation unless explicitly agreed in writing.

Project Configuration and Scope Review

The project configuration shows an estimated package, price and delivery window based on the options selected by the client. TM8 manually reviews each request before confirming final scope, availability, payment terms and production start.

f the submitted files and brief match the selected package, the confirmed price remains fixed for that agreed scope. If the files, complexity, missing materials, technical behavior, requested duration, or required deliverables do not match the selected package, TM8 will confirm a corrected scope before payment or production begins.

No additional work is added silently. Scope changes, corrections to the selected package, or expanded requirements are confirmed before they affect price or timeline.

Client Responsibilities

The client is responsible for providing accurate project information, authorized source materials, timely feedback, required approvals, and clear technical explanations of the process, mechanism, product behavior or visual sequence that should be shown.

The client confirms that they have the right to share any CAD files, drawings, references, logos, brand materials, product data or other materials provided to TM8 for the project.

Payment and Project Start

Payment is processed in USD through Stripe or another agreed payment method. A business invoice is issued for confirmed projects.

A project starts only after TM8 confirms the scope, delivery window, production availability and required payment terms, and after the required payment or deposit has been received.

A production slot is reserved only after payment is completed, unless otherwise agreed in writing.

Timeline and Availability

Delivery windows shown on the website are estimates based on selected scope and current availability. The confirmed timeline is provided after scope review and may depend on file quality, CAD readiness, client feedback speed, NDA timing, add-ons and production capacity.

If the client delays source materials, approvals, feedback, NDA completion or access to required files, the delivery window may be adjusted.

Reviews and Scope Changes

Projects include the review milestones described in the confirmed scope. The first draft review is used to approve the animation direction, camera movement, sequence, flow direction and technical behavior before final rendering begins.

Changes to the mechanism, process logic, animation sequence, product configuration or selected deliverables after approval may be treated as additional work and may affect price and timeline.

Corrections caused by TM8 production errors are handled without additional charge. New requests, changed inputs, late design changes and extra review rounds may be priced separately.

Deliverables and Usage Rights

Final deliverables are digital files such as MP4 videos, still images, or other agreed export formats. Exact format, resolution, duration and quantity are defined in the confirmed scope.

After full payment, the client may use the delivered final files for their own marketing, sales, trade show, website, product communication, training and internal communication purposes.

The client may not resell, redistribute, sublicense, or claim authorship of TM8 work as a standalone creative product unless explicitly agreed in writing.

Source Files and Working Files

Unless explicitly agreed in writing, source files, working scenes, shader setups, lighting rigs, render setups, project files, simulation setups and editable production files are not included in standard deliverables.

Final exported deliverables are the standard purchased output. Source files may contain proprietary production methods, reusable systems and licensed assets.

Confidentiality and Portfolio Use

TM8 treats non-public project materials, CAD files, technical drawings, product information and business information as confidential.

TM8 may show completed work in its portfolio, website, proposals or social media only when the work is public, approved by the client, or not restricted by NDA or written agreement.

If a project is confidential, under NDA, unreleased, or contains protected technology, portfolio use requires written permission.

File Transfer and CAD Handling

Sensitive CAD files and protected technical drawings should be shared through controlled transfer methods, such as the client's secure file link, client portal, MASV, or another agreed secure transfer path.

Submitted project materials are not used to train AI models. CAD files and technical materials are deleted according to the retention schedule described in the Privacy Policy, unless a different period is agreed in writing or required for legal reasons.

Cancellation and Refunds

TM8 may decline a project before production begins if the request, files, scope, technical materials or availability do not allow the project to be delivered responsibly. If payment has already been made and the project is declined before production starts, payment will be refunded according to the agreed payment terms.

If the client cancels after production has started, any refund or remaining balance depends on the work already completed, reserved production time, third-party costs and agreed payment terms.

After final delivery approval, refunds are not normally available for completed custom work.

Technical Accuracy and Limitations

TM8 aims to create technically accurate visual communication based on the files and explanations provided by the client. Visualizations are communication assets and should not be used as engineering validation, safety documentation, manufacturing instructions, simulation results, or regulatory approval materials unless explicitly agreed in writing.

The client remains responsible for checking technical correctness, product claims, safety statements, regulatory requirements and any engineering interpretation shown in the final deliverables.

Data Protection

Personal data and project materials are handled according to the TM8 Privacy Policy. In case of conflict between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy applies.

Governing Law and Contact

Unless otherwise agreed in writing, these terms are governed by the laws of Poland. The parties should first attempt to resolve any dispute in good faith through written communication before taking formal legal action.
